This is
your chance to win 6 tickets to the Monterey Bay Aquarium in

ENTER
The
Monterey Bay Aquarium Ticket Contest (“Sweepstakes”) will begin on
September 1, 2008 at 12:01am Pacific Time (PT) and end on October 12, 2008 at
11:59pm PT (“Sweepstakes Dates”).
To
participate in the contest, follow the instructions below:
On a
post card or 3”x5” card, hand draw the KMCE TV AZTECA 43/AZTECA
AMERICA “Feathers” portion of our logo, with or without color,
along with your hand printed words “AZTECA 43’ adjacent to your
drawing along with your first and last name, complete address, including city,
state, and zip code, and daytime telephone number (optional: include email
address and date of birth) in legible writing and submit by mail addressed to
AQUARIUM CONTEST, TV AZTECA 43, P.O. BOX 2095, Freedom, California
95019-2095. No alternate entry forms
will be accepted. No photocopies will be accepted. Mailed entries must be
postmarked by the last date of the Sweepstakes to be eligible. KMCE TV AZTECA 43 is not responsible for
lost, misdirected, delayed, destroyed, deleted, erased, stolen, unreadable or
mutilated mail. Mechanically reproduced entries will not be accepted.
PRIZES
A weekly
drawing will determine two weekly winners of six tickets per winner to the
Monterey Bay Aquarium. Each Ticket has a
value of $24.95 and may be used through March 31, 2009. The weekly drawing will be held on the first
Monday following the preceding week beginning with the contest start date and
continue weekly through the contest duration with the final drawing on the
Monday following the contest end date above. The awarding of the tickets will
be handled by KMCE TV AZTECA 43 and/or the Monterey Bay Aquarium.
WINNER
SELECTION AND NOTIFICATION
Decisions
of KMCE TV AZTECA 43 management with respect to the sweepstakes are final. The weekly drawing will be held on the first
Monday following the preceding week beginning with the contest start date and
continue weekly through the contest duration with the final drawing on the
Monday following the contest end date. The drawing will be held during normal
business hours where two (2) winners will be randomly selected from all
eligible entries received by the respective entry deadlines. Winner will be
selected off-air. The odds of winning depend upon the number of eligible
entries received by the entry deadline.
The
weekly winner will be notified by KMCE TV AZTECA 43 by e-mail, telephone,
and/or mail within five business days of selection. The winner will be required
to sign an affidavit of eligibility and a liability/publicity release, which
must be returned within 15 days of notification. If the winner cannot be
contacted within 30 Days of selection, an alternate winner will be selected at
random.

No Purchase Necessary
All entrants to contest broadcast and executed by KMCE TV AZTECA
43 both imply and agree to participate in the contest of their own volition,
and will follow the rules provided herein by said participation in the
contest. NO PURCHASE NECESSARY. PURCHASE DOES NOT INCREASE ODDS OF WINNING.
Void where prohibited. Odds of winning
depend upon the number of participants.
- KMCE TV AZTECA 43 may change the dates and/or terms of contests or promotions without
prior notice. Any material changes will be broadcast on the Station and/or
posted on its website located at www.Azteca43.TV. Unless
otherwise specified in Contest rules or other KMCE TV AZTECA 43
notifications, these general rules will apply to all Station Contests.
- All contest entries become property of KMCE-TV 43.
- Prizes are non-transferable or exchangeable and cannot be substituted.
- Taxes, gratuities and all other incidentals are the responsibility
of each and any winner. Any valuation of a prize(s) is based on available
information provided to KMCE TV AZTECA 43, and the value of any prize
awarded to a winner may be reported for tax purposes as required by
law. Each winner is solely
responsible for reporting and paying any and all applicable taxes related
to the prize(s) and paying any expenses associated with any prize which is
not specifically provided for in the official rules. Each winner may be required to provide
KMCE TV AZTECA 43 with valid identification and a valid taxpayer
identification number or social security number before any prize will be
awarded. Any person winning more
than $600 in prizes from the KMCE TV AZTECA 43 will receive an IRS form
1099 at the end of the calendar year and a copy of such form will be filed
with the IRS. If the prize includes
travel, lodging, entertainment, or a special event, winner is responsible
for all taxes, expenses, and gratuities not expressly included in and as
part of the prize. Winner agrees to
accept all blackout dates, space availability requirements, etc.

Winner agrees that acceptance of any trip taken as a prize from
KMCE TV AZTECA 43 does so entirely upon their own initiative, risk, and

- After winning a prize valued over $600, winner will not be eligible
to win any other prizes from KMCE-TV 43 for 1 year and will receive a 1099
form reflecting the value of the prize.
- All prizes must be claimed within 30 days of the date won or will
be forfeited and no other prize will be awarded in its place. If a winner cannot be contacted or is
disqualified, KMCE TV AZTECA 43 reserves the right to determine an alternate
winner or to not award that winner’s prize, in its sole
discretion. All prizes must be

43 retains the right to substitute a prize with another similar prize of
equal or greater value in the event the original prize offered is not
available due to circumstances beyond KMCE TV Azteca
43’s control. All prizes will be presented to winners
via United States Mail service, unless otherwise noted. Inability of winners to accept the
prizes will result in forfeiture. Certain
prizes may require winner to be 18 years of age or older, or have signed
permission of parent or legal guardian to accept the prize.
- Winners may be asked to provide proof of age, residency, identity,
social security number, and complete an affidavit of eligibility,
liability and publicity release.
- KMCE TV AZTECA 43, its
parent, subsidiary, affiliated companies, employees
or agents, Contest sponsor(s) and their advertising or promotional
agencies and their respective employees assume no responsibility or
liability for any and/or all damages, loss or injury resulting from,
participating in, acceptance, or use of the prize.
- Winner agrees to
indemnify and hold forever KMCE TV AZTECA 43, its parent, subsidiary,
affiliated companies, employees or agents, Contest sponsors(s), and their
advertising or promotion agencies their agents, officers, employees,
affiliates and assigns for any injuries, accidents, misfortunes, or causes
of action arising from or in connection with participation in any contest
and/or acceptance of the prize.
- By participating in any contest and accepting any prize, entrants
authorize KMCE TV AZTECA 43 to use their names, voices, likeness,
biographical data and city and state of residence for promotional reasons
and winners’ list with no further compensation.
- By entering in any contest, entrants authorize KMCE-TV43 to use
their address, phone and email information for KMCE-TV 43’s or
AZTECA
- By entering the contest(s),
you agree that information you provide may be used for internal purposes
of either KMCE TV AZTECA 43 or its Contest sponsors for purposes that may
include but are not limited to verification of eligibility, receipt of
direct mail or email, and contact by telephone.
- If the prize is tickets to a performance, KMCE TV AZTECA 43 is not
responsible for cancellations due to weather, promoter, performer, or
other reasons beyond KMCE TV AZTECA 43’s control, and shall have no
obligation to provide replacing the prize.
- If a prize requires
installation to property of any kind, the winner must be the owner of such
property and be able to display proof of ownership of the property where
the prize will be installed in order to be eligible. Winner shall be entirely responsible for
obtaining any necessary permits and payment of fees, required inspections,
or any other item, fee, tax, etc necessary for such installation. KMCE TV
AZTECA 43 will not be responsible for any damage caused by delivery or
installation.
- For entries by mail, KMCE TV AZTECA 43 is not responsible for lost,
stolen, mangled, misdelivered, illegible, incomplete or late entries.
- For call-in or entry by facsimile contests; only calls to the
specified phone number can win. KMCE TV AZTECA 43 will not be responsible
for errors or problems of internet or telephone systems that may prevent
callers or entries from reaching KMCE TV AZTECA 43. If a caller is
unintentionally disconnected before their names and phone numbers have
been recorded, another call will be taken for the prize. KMCE TV AZTECA 43
is not responsible for facsimile transmission errors, illegible entries,
telephone service outages, delays, busy signals, equipment malfunctions
and any other technological difficulties that may prevent transmitting
his/her facsimile entry.
- For Internet contests:
KMCE TV AZTECA 43, in its sole discretion, reserves the right to
disqualify any person tampering with the entry process, the operation of
KMCE TV AZTECA 43’s website or who is otherwise in violation of the
rules. KMCE TV AZTECA 43 further reserves the right to cancel,
terminate or modify the contest if it is not capable of completion as
planned, including infection by computer virus, bugs, tampering,
unauthorized intervention or technical failures of any sort.
Contestants are required to provide truthful information and KMCE TV
AZTECA 43 will reject and delete any entry that it discovers to be false
or fraudulent. KMCE TV AZTECA 43
will disqualify and delete any entry received from persons under the
minimum age requirement and will also delete entries received from any
person under the age of 13 in compliance with the Children’s Online
Privacy Act. KMCE TV AZTECA 43 is not responsible
for entries not received due to difficulty accessing the internet, service
outage or delays, computer difficulties or other technological glitches.
- KMCE TV AZTECA 43 is
not responsible for typographical or other errors in the printing, the
offering or the administration of the contest or in the announcement of
the prize.
- KMCE TV AZTECA 43 is
not responsible for the safe arrival and/or delivery of any prize.
- Employees of KMCE TV
AZTECA 43, the Contest’s participating sponsors and their
advertising agencies, employees of other radio or television stations, and
members of the immediate family of any such persons are not eligible to
participate and win. The term
“immediate family” includes spouses, siblings, parents,
children, grandparents, and grandchildren, whether as “in-laws,”
or by current or past marriage(s), remarriage(s), adoption, co-habitation
or other family extension, and any other persons residing at the same
household whether or not related. Employees of KMCE TV AZTEDA 43, its parent, subsidiary and
affiliated companies and participating sponsors are not eligible.
- Any violation of these rules will result in disqualification.
- All decisions of KMCE-TV43 are final and indisputable.
- Contest void where prohibited. All federal, state and legal laws
and regulations apply.
- KMCE TV AZTECA 43 retains the right to amend these rules and regulations at
any time for any reason.
